Hanson <br />As discussed at the February 26th Council meeting, the proposed Antenna/Tower <br />Ordinance has been modified to provide for an administrative permit for co- locations of <br />antennas on existing commercial towers and municipal water towers (see page 4 of the <br />proposed ordinance). <br />Staff has also reviewed provisions of other cities with regard to removal of abandoned or <br />damaged towers (see survey attached). It appears of the cities surveyed only Inver Grove <br />Heights requires a performance bond or letter of credit to ensure removal. Given Council <br />discussion at the last meeting regarding property values of land on which a tower might <br />be located, the legalities of assessing removal costs against a property with a low <br />property value, and that the hazardous building statute can result in higher legal costs <br />without the guarantee of timely collection of costs, staff would recommend the following: <br />H. OBSOLETE OR UNUSED TOWERS AND ANTENNAS. All obsolete <br />or unused towers or portions thereof and accompanying accessory facilities shall <br />be removed within 12 months of the cessation of operations at the site unless a <br />time extension is approved by the City Council. To ensure the removal of <br />obsolete and unused towers or portions thereof and antennas, the applicant shall, <br />prior to the issuance of a conditional use permit, submit a performance bond or <br />letter of credit in an amount sufficient to cover the removal costs of the tower, <br />antennas and accessory facilities. After the removal of the facilities, the site shall <br />be restored to its original or an improved state. <br />If the underlying property has sufficient value as determined in the sole discretion <br />of the City Council, the applicant may substitute the following for the <br />performance bond /letter of credit requirement: <br />Page 1 <br />
