Tobacco Regulations <br />Page Two <br />Sale of "loosies" and "kiddie packs" — FDA prohibits the sale of cigarettes <br />individually or in any package containing fewer than twenty cigarettes. Little <br />Canada does not address this. <br />Coupons — FDA restricts the redemption of coupons and smokeless tobacco to <br />persons over the age of 18 and only in a store, not by mail. Little Canada does not <br />address. <br />Free Samples — FDA prohibits free samples of cigarettes and smokeless tobacco. <br />Little Canada does not address. <br />Outdoor Advertising — FDA prohibits all outdoor advertising, including <br />advertising outwardly visible from windows, if the advertising is located within <br />1,000 feet of a school or public playground. Little Canada does not address. <br />Other Advertising — FDA restricts all other advertising to black text on a white <br />background without pictures or colors, except when used in a location where <br />persons under 18 are, at all times, prohibited from entering, or in any publication <br />that has a youth readership of 15% or less and fewer than 2 million youth readers. <br />Little Canada does not address. <br />Give -a -ways for proofs -of- purchase — FDA prohibits the exchange of free gifts <br />or other items to anyone in exchange for a tobacco proof -of- purchase. Little <br />Canada does not address. <br />Use of brand names on non - tobacco items — FDA prohibits the use of brand <br />names or logos, symbols, or other marks identifying a non- tobacco item (such as <br />t -shirt, hats, and gym bags) with a cigarette or smokeless tobacco brand. Little <br />Canada does not address. <br />Sponsorship — FDA prohibits the sponsorship of any sporting or other event, <br />team, or entry, in any manner identifiable with a tobacco brand. Little Canada <br />does not address. <br />If the Council desires to apply for a waiver, staff should be authorized to participate in <br />the coordinated process being overseen by the League of Minnesota Cities.
