MINUTES <br />CITY COUNCIL <br />FEBRUARY 26, 1997 <br />OF THE PLANNING COMMISSION FOR IMMEDIATE RELOCATION OF <br />THE SMALL SHED, AND FUTURE RELOCATION OF THE GARAGE <br />WHICH ENCROACHES ONTO BOSS ROAD RIGHT -OF -WAY AT SUCH <br />TIME AS BOSS ROAD IS IMPROVED, AND FURTHER APPROVING <br />THE ABATEMENT OF WATER MAIN ASSESSMENT IN THE AMOUNT OF <br />$1,548.81 ON THE PROPERTY AT THIS TIME WITH THE <br />INDICATION THAT THE PROPERTY WOULD BE REASSESSED AT <br />SUCH TIME AS BOSS ROAD IS IMPROVED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Morelan, LaValle, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />ZONING Scalze opened the public hearing to consider amending <br />ORDINANCE the Zoning Ordinance relative to accessory buildings, <br />TEXT garages, and sheds. <br />AMENDMENT - <br />ACCESSORY The City Administrator reported that the Building <br />BUILDINGS, Official has pointed out the current ordinance <br />GARAGES, does not allow for placement of air conditioning <br />AND SHEDS equipment in the required side yard setback. There are <br />a number of violations of this provision, and the City <br />asseseilie would have to make changes in the process to ensure <br />this placement did not occur in the future. The <br />Building Official has also indicated this is not a <br />typical requirement. Therefore, he is recommending the <br />reference to air conditioning equipment be deleted from <br />Section 903.020.D.8. The Planning Commission has <br />recommended this provision of the Code be enforced, and <br />air conditioning units not be allowed to be placed in <br />required side yards. <br />The City Planner reviewed the proposed ordinance <br />regulating accessory sheds. The Planner pointed out <br />that this ordinance redefines a private garage to be a <br />structure that has a minimum garage door width of 7 <br />feet. The ordinance also clarifies the numbers of <br />accessory buildings, garages, and sheds allowed per <br />lot. If a property has a house with an attached garage <br />garage, it would be allowed one accessory building and <br />one shed. An additional garage would require a <br />Conditional Use Permit. If a property has a house with <br />a detached garage, it would be allowed one accessory <br />building and one shed. A second garage would require a <br />Conditional Use Permit. <br />Scalze pointed out the reference to farm buildings and <br />accessory sheds in Section 903.020.D.2.a, and asked <br />what this section says with regard to placement of farm <br />buildings. <br />3 <br />Page 27 <br />
