manufactured home communities, some opened for several <br />years, and some opened recently, which enjoy off -street <br />parking similar to the off - street parking at North Star <br />Estates. North Star will provides the names, locations and <br />photographs of many of these communities upon request. <br />Moreover, people residing in any other types of homes in <br />Little Canada, Ramsey County and the State of Minnesota, <br />are not subject to the same requirements. For example, <br />occupants of a single family home often park their cars in <br />an attached garage inches from the residence. The <br />occupants of a multi- family dwelling frequently are <br />provided off -street parking within a few feet of the <br />dwelling itself. <br />Third, granting the variance will not be contrary to the <br />public interest or damaging to the rights of any property <br />owners. Granting the variance will not be contrary to the <br />public interest or damaging the rights of other persons or <br />properties. Allowing the variance will have no impact on <br />any person residing or working outside of North Star <br />Estates. North Star Estates is a self- contained community, <br />and whether its residents park off -street will affect only the <br />residents of North Star Estates, North Star, and, as <br />discussed below, the City, County and State (because the <br />state and local government must be concerned with the <br />negative impact that eliminating off -street parking would <br />have on the health and safety of the residents of North Star <br />Estates). <br />Fourth, granting the variance will not be contrary to the <br />policy and intent of Minn. Stat. § 327.20, subd. 1, para. 3, <br />or detrimental to the public health, safety and welfare. <br />Minn. Stat. § 327.20, subd. 1, para. 3, was enacted in <br />1951 at a time when most manufactured homes were <br />actually trailers frequently pulled behind motor vehicles and <br />not built as permanent structures. Thus, the most common <br />manufactured homes in 1951 offered little fire protection <br />and, because they were frequently and easily pulled by <br />motor vehicles, were likely even attached to motor vehicles <br />when in use. The 1951 requirement of a 10 foot separation <br />between parking and adjacent homes obviously resulted <br />from a safety concern because of the possibility of fire <br />resulting in one of two ways. First, overheating motor <br />vehicles might cause fires in manufactured homes, and, <br />second, inadequate fire safety construction of poorly <br />Page 66 <br />
