ENCROACHMENT LICENSE AGREEMENT, made this IS -bday of r)//)., J , 1980, between NORTHERN STATES POWER COMPANY, a Minnesota corporation (hereinafter called "NSP "), and ROBERT DALE DEBACE, sole owner, (hereinafter called "Licensee "), WITNESSETH: That for and in consideration of the covenants and agreements hereinafter contained to be kept and performed, NSP and Licensee hereby agree that: 1. NSP does hereby grant unto Licensee, 'its successors and assigns, a License to encroach upon and to occupy and to use, in the manner hereinafter specified, the following described pro- perty located in Ramsey County, Minnesota, over which NSP has a 130 foot wide electric transmission line easement, to -+wit: 9.gttlot._.D4 , Ryan Indu_s_t_ria_l Park, Ramsey County, Minnesota - _ which easement is dated August 16, 1973 and filed for record in the office of the Ramsey County Recorder September 28, 1973 as Document No. 1867136. 2. It is hereby agreed that the description of the property encumbered by the easement as stated in paragraph 1 above is correct and shall apply notwithstanding the fact that it is different from the description used in the aforementioned easements. 3. The right of encroachment granted herein shall be limited' to that part of the aforedescribed Outlot D described as follows: A 40' x 100' rectangle, the south line of which is - 100' in length and runs 15' north of and parallel to the south line of said Outlot D and the west line of said rectangle is 40' in Length and is located 35', more or less, east of the west line of said Outlot D.
