Hanson <br />Attached is a letter from the Gambling Control Board (GCB) regarding the City's <br />expenditures from its 10% Gambling Fund. I have also provided a copy of the statute <br />and the listing prepared by the GCB relative to lawful expenditures. The following is a <br />List of options for resolving the matter: <br />1. Reimburse the 10% Furd from the Capital Improvement Fund and inform the GCB <br />that we will expend 10% dollars on future lawful expenditures. <br />2. Reimburse the 10% Fund from the Capital Improvement Fund and pay for any past <br />expenditures (1995, 1996) as outlined on attached listing. This could be done on a <br />partial basis if there are expenditures you are not comfortable with. <br />3. Take a formal position disagreeing with the Gambling Control Board and not <br />reimburse the 10% Fund at this time. This option needs to be reviewed with the City <br />Attorney. <br />My recommendation would be Option #2. I do not feel it is warranted to aggressively <br />contest the GCB's position given the potential for large expenditures of time and money <br />in doing so. I believe we can achieve an acceptable outcome by pursuing legislative <br />clarification to the definition of "lawful purpose ". (This would involve further <br />discussions with our local legislators and attempting to solicit the support of the League <br />of Minnesota Cities.) We could also consider filing a statement of protest with the GCB <br />questioning their position should the Council choose Option #1 or #2. <br />Page 48 <br />
