Weavers and McGuire: <br />After review of the water surface use ordinance for Lake Gervais, I am approving <br />Ordinance 452. which you have submitted on behalf the Cities of Little Canada and <br />Maplewood with the stipulation that the following changes be made in each ordinance: <br />1301.050 ENFORCEMENT. A comment from our Enforcement Division has resulted in a <br />change in the enforcement language for these ordinances. The wording should now <br />read: <br />"Primary enforcement of this ordinance shall be the responsibility of the Ramsey <br />County Sheriffs Department. This, however, shall not preclude enforcement by <br />other licensed peace officers." <br />21.103 BOAT LAUNCHING. This section is not specifically a water surface use restriction, <br />but rather one on access to the water. Since it does not fall into the category of water <br />surface use, / am specifically excluding it from review and approval. The cities should <br />also be aware that the 1997 legislature amended M.S. § 866.201 in May by adding a <br />subdivision which is effective on August 1, 1997, and will probably supersede any local <br />restrictions on nonmotorized access. The new subdivision reads as follows: <br />"Subd. 3.
