Hanson <br />Enclosed are two ordinances dealing with telecommunication systems and the management of <br />city right -of -way. First is the League of Minnesota Cities (LMC) Model Right -of -way <br />Ordinance. Second is a model telecommunications ordinance prepared by Tom Creighton, <br />attorney for North Suburban Cable Commission. It is highly recommended by both <br />organizations that we adopt an ordinance to manage the public right -of -way. In Tom <br />Creighton's memo, he indicates why he feels his draft is superior to the LMC model. Staff at the <br />Cable Commission is strongly recommending adoption of Mr. Creighton's model as this will be <br />needed relative to the franchise renewal process. Based on my review of the ordinances, I would <br />support the Creighton model. It should also be noted that until we actually apply this ordinance, <br />it is hard to estimate how well it will work for us. <br />If the Council is so inclined, they can adopt one of the two ordinances at Wednesday's meeting. <br />If you would like to study this matter further, then I would suggest we call for a workshop to <br />review these ordinances in more detail and decide upon the provisions that are important to us. <br />JRH:kpv <br />Enclosures <br />Page 65 <br />
