way has been granted by the City under this Chapter. <br />(v) "Person" means any natural or corporate person, business association or other <br />business entity including, but not limited to, a partnership, a sole proprietorship, a <br />political subdivision, a public or private agency of any kind, a utility, a successor or <br />assign of any of the foregoing, or any other legal entity which has or seeks to have <br />equipment in any right -of -way. <br />(w) "Probation" means the status of a person that has not complied with the conditions of <br />this Chapter. (Note: This paragraph is included as an option for your city.) <br />(x) "Probationary Period" means one year from the date that a person has been notified <br />in writing that they have been put on probation. (Note: This paragraph is included as <br />an option for your city.) <br />(y) "Registrant" means any person who (I) has or seeks to have its equipment located in <br />any right -of -way, or (2) in any way occupies or uses, or seeks to occupy or use, the right - <br />of -way or any equipment in the right -of -way. <br />(z) "Repair" means the temporary construction work necessary to make the right -of- <br />way useable for travel. <br />(aa) "Restoration Bond" means a performance bond, a letter of credit, or cash deposit <br />posted to ensure the availability of sufficient funds to assure that right -of -way excavation <br />and obstruction work is completed in both a timely and quality manner. <br />(bb) "Restore or Restoration" means the process by which an excavated right -of -way and <br />surrounding area, including pavement and foundation, is returned to the same condition <br />that existed before the commencement of the work. <br />(cc) "Restoration Cost" means an amount of money paid to the City by a permittee to <br />cover the cost of restoration. <br />(dd) "Right -of -Way" means the surface and space above and below a public roadway, <br />highway, street, cartway, bicycle lane and public sidewalk in which the City has an <br />interest, including other dedicated rights -of -way for travel purposes and utility easements <br />of the city. <br />(ee) "Right -of -Way Permit" means either the excavation permit or the obstruction <br />permit, or both, depending on the context, required by this Chapter. <br />(ff) "Service" or "Utility Service" includes but is not limited to (1) those services <br />provided by a public utility as defined in Minn. Stat. § 216B.02, subds. 4 and 6; (2) <br />telecommunications, pipeline, community antenna television, fire and alarm <br />communications, water, electricity, light, heat, cooling energy, or power services; (3) the <br />services provided by a corporation organized for the purposes set forth in Minn. Stat. § <br />300.03 ; (4) the services provided by a district heating or cooling system; and (5) cable <br />communications systems as defined in Minn. Stat. Chap. 238. <br />Page 73 <br />
