Little Canada Road <br />Little Canada, MN 55117 <br />Dear Joel: <br />Hello! I am the project coordinator for the North Suburban Tobacco Compliance Project (NSTCP). I <br />contacted each of you in the last few weeks via letter and phone to introduce myself and to introduce you to <br />our tobacco program. My hope was that you would be interested in joining our program and contributing to <br />our primary goal of reducing youth access to tobacco. Many of the non - participating cities I contacted <br />were interested in getting on board, however the timing was notes critical issue — until now. <br />As most of you know, Governor Carlson recently signed the youth anti - smoking bill which will affect all of <br />you starting August I, 1997. After speaking with a few of the cities since the law was signed, I discovered <br />that there was much confusion about what was included in the new law and what was required of each city. <br />Below is a breakdown of the new law to help you clarify how it will affect you: <br />NEW STATE LAW (Effective August 1, 1997 -- cities may exceed any of these minimum standards.) <br />J,icense fee: Required: Fee to be set by licensing authority. Currently city fees range from <br />$25 - $300. <br />Compliance check% At least one per year required. <br />Prohibit vending machine: Yes, unless establishment cannot be entered by minor. Most bars do not <br />qualify. <br />Self- service prohibited Self- service is prohibited of single packs of cigarettes or smokeless tobacco. <br />Multipack displays OK. It excludes "tobacco-only" retail establishments. FDA regulations are scheduled <br />to go into effect August 1997 and those regulations ban all self service. <br />Seller over 18. No provision for <br />Penalties for minors in a 24 -month period: Currently this is a petty misdemeanor. If a MN driver's license <br />or ID is used in an attempt to purchase, then: lst: 90 day suspension of driver's license. 2nd: may revoke <br />license until 18 (may OK work privileges).
