MINUTES <br />CITY COUNCIL <br />JUNE 25, 1997 <br />STATUTE <br />1306 <br />ORDINANCE NO. 456 — AN ORDINANCE AMENDING THE <br />LITTLE CANADA ZONING ORDINANCE TO MAKE HOME <br />OCCUPATION LICENSE RENEWALS AN ADMINJS'TRATIVE <br />PERMIT PROCESS <br />The foregoing ordinance was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Pedersen, Fahey, LaValle. <br />Nays (0). Resolution declared adopted. <br />Mr. Dale Langfoss, an architect representing the Church of Jesus Christ of <br />the Latter -Day Saints, appeared before the Council requesting that the City <br />repeal its adoption of State Statutel306, Special Fire Protection Systems. <br />Langfoss reported that the Church is doing some remodeling as well as a <br />small addition. Because ot'the small addition, the requirements of Section <br />1306 kick in and the entire building will have to be sprinkled. <br />Scalze stated that it was her understanding the City could not exempt <br />anyone from Section 1306 requirements. Fahey replied that there is no <br />exemption provision, the issue is whether or not the City is willing to <br />repeal Section 1306. <br />Morelan stated that he was a firm believer in sprinkler systems, and <br />suggested the Church look at it from a public safety standpoint. Morelan <br />stated that he was not in favor of repealing Section 1306. <br />Fahey reviewed the Building Official's letter dated June 18'1' which points <br />out that the additional floor area increases occupancy of the building <br />which then triggers the requirement that a fire suppression system be <br />installed. <br />Langfoss reported that in reality the occupancy of the building is not <br />increasing. The addition will add a youth room and nursery area to the <br />building, but in reality will not increase the occupancy. <br />Fahey indicated that he was not willing to eliminate Section 1306, and if <br />the City exempts this situation, it better be willing to abandon the <br />requirement throughout the City. Morelan agreed; however, asked <br />whether the last sentence in Subparagraph 3 applied in this case. <br />The City Administrator replied that the Church is a Group A occupancy; <br />therefore, the exemption noted in this paragraph does not apply. <br />Fahey indicated that it would be a major shift in public policy to eliminate <br />Section 1306.
