MINUTES
CITY COUNCIL
JUNE 25, 1997
possible to change the tire rating on the walls adjoining the addition, add
smoke alarms, etc. Alsop pointed out that in addition to the cost, a
sprinkler system would be very unsightly given the existing ceilings.
Fahey asked if the situation were all or none and if there was another way
to address it. Fahey asked if there were alternative building codes that
could be adopted. Fahey felt Section 1306 appeared to be overreaching
for small additions, and asked if there was a way the City could use some
discretion in these situations. Fahey suggested the matter be tabled for
two weeks pending a report from the Building Official. Fahey indicated it
seems the affects of Section 1306 are overreaching in this case, and asked
if the City was allowed any discretion for small additions.
The City Administrator indicated that he can have the Building Official
report further on this matter. However, he did not believe there were any
options in addition to what has already been identified relative to Section
1306.
Fahey stated that he would like to challenge the Building Official to find
an option. Morelan suggested perhaps the City could write its own Code
and allow for small additions without the need for installation of a fire
suppression system. Scalze suggested the City look at how the City of
Bloomington addressed the situation.
Mr. Fahey introduced the following resolution and moved its adoption:
RESOLUTION NO. 97 -6 -151 — TABLING ACTION ON THE
REQUEST OF THE CHURCH OF JESUS CHRIST OF THE
LATTER-DAY SAINTS FOR REPEAL OF STATE STATUTE
SECTION 1306 FOR TWO WEEKS AND REQUESTING THE
BUILDING OFFICIAL REPORT ON OPTIONS FOR ADDRESSING
THE CITY'S OB.IECTIVES IN A DIFFERENT WAY, THAT IS,
ALTERNATIVE BUILDING CODES, ETC
The foregoing resolution was duly seconded by LaVatle.
Ayes (5) Fahey, LaVatle, Scalze, Pedersen, Morelan.
Nays (0). Resolution declared adopted.
RECESS At this point in the meeting, 8:50 P.M., the Council took a short recess.
The meeting was reconvened at 9:00 P.M.
Page 11
