NXC <br />MEMORANDUM <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: September 9, 1997 <br />RE: Little Canada - Robert Johnson Property Division <br />FILE NO: 758.09 - 97.21 <br />Mr. Robert Johnson has requested approval of a subdivision which would divide his <br />property at the intersection of Demont Avenue and Park Street into two lots. Mr. Johnson's <br />house is located on the south portion of the property, and the north portion would be sold <br />for another dwelling. The lot with the existing house would be approximately 14,331 <br />square feet in area, and the new lot would be approximately 11,442 square feet in area. <br />Both lots conform to the area and width requirements of the zoning ordinance. <br />Mr. Johnson's current home faces Demont, and the Zoning Ordinance would consider <br />Demont to be the front since the Demont frontage is less than the Park Street frontage. <br />As a result, the new property line dividing the current home site from the new lot would <br />constitute the rear line for Mr. Johnson's property. The proposed survey details the rear <br />yard dimension to be 26.1 feet. The Zoning Ordinance requires a rear yard of at least 30 <br />feet. <br />The proposed lot line was apparently placed in the proposed location as a matter of <br />convenience based upon previously platted lot lines. There is adequate room to move the <br />proposed lot line four feet to the north. This revision would leave more than the required <br />10,000 square feet for the lot to the north, and would leave the rear setback for Mr. <br />Johnson's existing home in compliance with the 30 foot requirement. <br />Since there does not appear to be any physical condition of the and which would make <br />compliance with all of the Zoning standards impractical, no variance is appropriate.
