Hanson <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Mary Granley <br />DATE: October 14, 1997 <br />RE: Klein Property Update <br />Following is a timeline of events to update you on the progress that has occurred in regard to the <br />Klein property at 2620 Rice Street: <br />• On August 29, 1997 a letter was sent to Doris and Dennis Klein informing them of the <br />City's offer to fill, grade and seed their property and to assess the costs for such in order <br />to bring their property into compliance with zoning and municipal codes. No response <br />was received. <br />• On October 14, 1997 an anonymous complaint was received stating that filling was <br />occurring on the Klein property site. The complaint alleged that the fill was removed <br />from Holiday Station Store at 629 Rice Street and was petroleum contaminated. The fill <br />was delivered by Jacobsen Excavating to the Klein property location. <br />• On October 14, 1997 I inspected the Klein property site, and filling and grading was <br />completed. This filling and grading occurred without benefit of a Filling and Grading <br />Permit, as required by City Ordinance 1501.010. I obtained pictures and soil samples of <br />the area. <br />• On October 16, 1997 I spoke with Jejil Abdella from the Minnesota Pollution Control <br />Agency. Mr. Abdella informed me that 629 Rice Street has been in their system since <br />January 1996 as having contaminated soil (leak #9100). At this point, Mr. Abdella is in <br />the process of contacting a Holiday Station Stores representative. Mr. Abdella is <br />planning an inspection of 629 Rice Street to note any soil disturbance, and if this is <br />evident, he will contact Jacobsen Excavating and Doris Klein for questioning and pull <br />soil samples from the Klein property for testing. If soil disturbance at 629 Rice Street is <br />not noted, Mr. Abdella stated it would not be possible to conclude the soil came from that <br />particular station. <br />Page 108 <br />
