AGREEMENT AND CONSENT TO REMOVAL AND <br />ASSESSMENT <br />THIS AGREEMENT is made this day of , 19 <br />by and between Dennis Klein and Doris Klein, hereinafter "Owners," and the City of Little <br />Canada, Ramsey County, Minnesota, hereinafter "City." <br />WHEREAS, Dennis Klein and Doris Klein have requested that the City fill the house <br />foundation on their property located at 2620 Rice Street, and grade and seed the area in a manner <br />in compliance with City zoning and municipal code regulations; and <br />WHEREAS, the Owners have reviewed the costs to be incurred by the City for the filling <br />of the foundation area and grading and seeding of the area totalling S and find <br />these costs to be both reasonable and necessary; and <br />WHEREAS, the City previously incurred costs in the amount of 35,300.00 for the <br />removal and demolition of the fire- damaged house pursuant to the Order of the Honorable <br />Joseph E. Salland dated July 30, 1992, and the Owners agree that these costs are both valid and <br />reasonable; and <br />WHEREAS, the City finds that due to a deterioration of the foundation and the overall <br />condition of the property, the property at 2620 Rice Street falls within the definition of hazardous <br />property under Minnesota Statutes Section 463.15, Subdivision 3. <br />NOW, THEREFORE, IT IS AGREED that the costs incurred by the City for the <br />aforementioned work and the costs incurred for the demolition of the fire- damaged house in <br />1992 totaling S shall be levied against the property.
