City of Little Canada <br />Ordinance Change Proposal <br />29 September, 1997 <br />Eden Prairie (Attachment 2) <br />Eden Prairie has adopted (May 20, 1997) ordinance code language which allows antennae <br />within residential zones on "public streets and rights -of -way when attached to, or part of a <br />public utility structure "2 using an administrative review process. <br />Maplewood (Attachment 3) <br />Maplewood has adopted (January 13, 1997) ordinance language which allows "Wireless <br />telephone antennas (sic), where located on an existing structure shall not extend more <br />than twenty -five (25) feet above the structure to which they are attached. Such antennas <br />(sic) are a permitted use in all zoning districts of the city. "3 <br />Plymouth (Attachment 4) <br />Plymouth has adopted ordinance language which allows "Personal wireless service <br />antennas (sic) located upon public structures or existing towers "4 and requires assurance <br />by engineering analysis that the site meets the needs and requirements for the site and that <br />the transmitting and switching equipment to be screened from view to meet their <br />administrative permitting process. <br />Proposed Language <br />We would like the City of Little Canada amend its ordinance to be changed to reflect the <br />possibility of co- locating antennae to Public Utility Structures and to be subject to a site <br />plan review under an Administrative Review Process in all zoning districts. <br />To that end, we would suggest adding the following definition to Section lc., Chapter <br />902.010 of your municipal code: <br />"Public Utility Structure: -- A structure or pole supporting wires for <br />communication or transmission of data or electricity. "' <br />We would also suggest amending Chapter 903.140, Section A ELIGIBLE ZONING <br />DISTRICTS to include Public Utility Structures as exceptions in co- location situations, <br />"...except that co- locations of antennas on existing commercial towers, Public <br />Utility Structures, and municipal water towers shall be allowed by administrative <br />permit." <br />We would also recommend that the Residential districts to be added for these Public <br />Utility Structure co- location sites as allowable under administrative review. <br />2 City of Eden Prairie, City Code Chapter 11.06, Subdivision 3B -3. <br />3 City of Maplewood, City Code Ordinance, Chapter 36, Article XI, Commercial Use Antennas and Towers, <br />Section 36- 607c.9. <br />4 City of Plymouth, City Code Ordinance, Section 21175.07 Personal Wireless Service Antennas, <br />Subdivision Ia. <br />City of Eden Prairie, City Code Chapter 11.06, Subdivision 3B -3. <br />Page 34 <br />Paee$ oI 16 <br />
