Provinces of Little Canada Project <br />Dear Tod& <br />7oe1Hanson and I have reviewed the Tax Credit Usage Agreement. We have the <br />following comments: <br />1. Please replace the fourth recital with the following: '7a connection with the <br />Project's eligibility for Credits, the Partnership intends to request that the City <br />issue a detennination under section 42(m)(2.)(3) of the Internal Revenue Code of <br />1986 (the "Section 42(m) Determination ") regarding the Project's need for the <br />amount of Credits generated by the Project." <br />2. In the fifth Recital please specify in an attachment to the Agreement the specific <br />rehabilitation work that was undertaken and completed. <br />3. Please replace the sixth recital with the following: "In connection with the section <br />42(m) Determination, the City desires to impose certain requirements with respect <br />to the operation of the Project and the percentage of the Project which would be <br />eligible for Credits." <br />4. Please replace existing (1) Restrictions on Law Income in the Covenants and <br />insert the revised 'Restrictions on Low Income" contained in the enclosed Insert <br />5. Please replace existing Paragraph (2) Operation, with the following <br />a The Partnership will undertake thorough tenant screening including, but not <br />limited to, credit and criminal checks of eachprospective.resident. The <br />purpose of this screening wiilbe to preventundesirable or problematic <br />individuals from gaining occupancy in the Project. <br />b. The Partnership will require the execution of the document entitled "House <br />Rules and Regulations" by each new tenant.
