new structure is substantially similar in design and color to the exiting or proposed <br />structure and extends no more than 20 feet above the highest point of the existing <br />or proposed structure. <br />Subd. 6. <br />following: <br />Exceptions. The provisions of Subds. 4 and 5 shall not apply to the <br />1. Water towers and poles supporting emergency warning devices to which <br />are attached antennas. <br />2. Church sanctuaries, steeples and bell towers to which are attached <br />antennas. <br />3. In accordance with the preemption ruling PRBI of the Federal <br />Communications Commission, towers for amateur radio communication <br />that comply with other provisions of City Code Chapter 11 relating to <br />towers. <br />Subd. 7. Co- Location Requirements. All commercial wireless telecommunication towers <br />erected, constructed, or located within the City shall comply with the following requirements: <br />A. A proposal for a new commercial wireless telecommunication services tower shall <br />not be approved unless the City Manager or his designee finds that the <br />telecommunications equipment intended to be attached to the proposed tower <br />cannot be accommodated on an existing or approved tower, public utility structure, <br />or building within one mile (one -half mile for towers under 120 feet in height, one <br />quarter mile for towers under 80 feet in height) of the proposed tower due to one <br />or more of the following reasons: <br />1. The planned equipment would exceed the structural capacity of the <br />existing or approved tower, public utility structure or building, as <br />documented at applicant's expense by a qualified and licensed professional <br />engineer, and if owned by applicant the existing or approved tower, public <br />utility structure or building, cannot be reinforced, modified, or replaced to <br />accommodate planned or equivalent equipment at a reasonable cost. <br />2. The planned equipment would cause interference materially impacting the <br />usability of the existing or planned equipment at the tower, public utility <br />structure or building as documented at applicant's expense by a qualified <br />licensed professional engineer and the interference cannot be prevented at <br />a reasonable cost. <br />3. Existing or approved towers, public utility structures and buildings within <br />the search radius cannot accommodate the planned equipment at a height <br />necessary to function reasonably as documented at applicant's expense by <br />a qualified licensed professional engineer. <br />Page 59 <br />
