DEVELOPMENT CONTRACT <br />AGREEMENT, dated April 24, 1996, by and between the CITY OF LITTLE <br />CANADA, a Minnesota municipal corporation, ( "City ") and Heritage <br />Development Minnesota, Inc., a Minnesota corporation, ( "Developer "). <br />1. Request for Improvement. The Developer has requested the City to <br />allow the construction of sanitary sewer, storm sewer, water main, curb and <br />gutter, bituminous drives, signage, and lighting necessary to serve and <br />provide access to the proposed plat of Heritage Office Park 2nd Addition <br />within the City of Little Canada to serve the following described property, <br />as shown on Exhibit "A ": <br />Lots 1 -5, Block 1, Heritage Office Park 2nd Addition, County of <br />Ramsey, State of Minnesota. <br />2. Conditions of Approval. The City hereby approves construction of <br />necessary extensions of sanitary sewer, storm sewer, water main, curb and <br />gutter, bituminous drives, signage, and lighting to serve the Heritage <br />Office Park 2nd Addition plat, conditioned upon the Developer entering into <br />this Agreement and guaranteeing compliance with terms of this Agreement. <br />3. Compliance with Laws and Regulations. The Developer represents <br />to the City that to the best of its knowledge the construction of <br />improvements to serve the Heritage Office Park 2nd Addition subdivision <br />will comply with all City, County, Metropolitan, State and Federal laws and <br />regulations, including, but not limited to, subdivision ordinances, zoning <br />ordinances, and environmental regulations; including wetland impact and <br />mitigation. The Developer shall obtain all necessary permits and consents <br />for the project including, but not limited to, the permit required by the <br />Minnesota Department of Health due to the water main extension, any <br />necessary permits required from the Minnesota Pollution Control Agency for <br />-1- <br />Page 14 <br />
