802. CIGARETTE SALES <br />802.010. LICENSE REQUIRED. It shall be unlawful for any <br />person to deal in or sell at retail any cigarettes without having <br />first obtained a license to do so as herein provided. <br />802.020. APPLICATION. Any person desiring a license to <br />engage in the business of dealing in or selling cigarettes shall <br />first make application therefor to the Council of the City by <br />filing with the City Administrator for presentation by him to the <br />Council an application in writing, which application shall set <br />forth the name and place of residence of the applicant and the <br />exact location of the place at which the applicant proposes to <br />carry on said business. Said application shall be signed by the <br />applicant in person, and when received by the City Administrator <br />shall be placed on file; provided, however, that no such <br />application shall be received unless it is accompanied by the <br />payment of a fee as provided for herein. <br />802.030. DEPOSIT FEE. At the time of filing an application <br />for a license to engage in the business of selling cigarettes at <br />retail, the applicant shall deposit with the City Administrator the <br />sum of Fifty Dollars ($50.00) and the Administrator shall <br />thereupon deliver to the applicant a receipt therefor containing a <br />statement of the purpose for which the deposit was made and a copy <br />of said receipt shall be attached to and filed with the <br />application. <br />802.040. INSPECTION. Any applicant shall permit the officers <br />of the City to inspect and examine the place of business described <br />in the application and any refusal on the part of the applicant to <br />permit such inspection will be sufficient ground for the Council to <br />refuse the license applied for. <br />802.050. LICENSE GRANTED BY RESOLUTION. The Council shall, <br />after whatever investigation it deems necessary, by resolution <br />grant the license applied for by such applicant, if in the opinion <br />of the Council he is entitled thereto. <br />802.060. ANNUAL LICENSE YEAR AND FEE. The annual cigarette <br />license shall commence July 1 of each year. The annual fee shall <br />be determined by resolution of the City Council. If the <br />application is made after January 1, the annual fee shall be <br />prorated on a monthly basis.
