keep, possess or operate or permit the keeping, possession or <br />operation of, on any licensed premises, or in any room adjoining <br />the licensed premises, any slot machine, dice, black jack table, or <br />any gambling device or apparatus, whether or not said devices are <br />being used in violation of M.S. 609.755 or 609.76. A black jack <br />table which is not being used in violation of M.S. 609.755 or <br />609.76 shall be exempt from this prohibition. No licensee shall <br />permit any gambling on the licensed premises. This Section shall <br />not preclude lawful gambling pursuant to M.S. 349 nor shall it <br />preclude the possession of properly licensed and registered <br />gambling equipment as defined in M.S. 349.12, Subd. 15. No <br />licensee shall permit the licensed premises or any room therein or <br />any room in any adjoining building, directly or indirectly underhis <br />control, to be used as a resort for prostitutes or other disorderly <br />persons. <br />702.080. VIOLATION BY AGENT. Every licensee is responsible <br />for the conduct in the licensed establishment and any sale of <br />alcoholic beverages by any employee authorized to sell such <br />beverages is the act of the licensee. <br />702.090. HOURS OF SALE. No nonintoxicating 3.2 percent malt <br />liquor shall be sold between the hours of 1:00 o'clock a.m. and <br />8:00 o'clock a.m. on the days of Monday through Saturday, nor <br />between 1:00 o'clock a.m. and 10:00 o'clock a.m. on Sundays. No <br />"on- sale" licensee shall permit the consumption of nonintoxicating <br />3.2 percent malt liquor during the hours when sale is prohibited, <br />except that the licensee shall be allowed a 30 minute period <br />following closing to clear the premises. Any customer purchasing <br />nonintoxicating 3.2 percent malt liquor prior to 1:00 o'clock a.m., <br />may consume such beverage on the premises up until 1:30 o'clock <br />a.m. Under no circumstances shall any individuals, whether or not <br />customers, other than the owners or employees of the licensee, be <br />allowed to remain on the premises after 1:30 o'clock a.m. <br />702.100. RESTRICTIONS ON PURCHASE AND CONSUMPTION. <br />(1) The provisions of Minnesota Statutes Section 340A are <br />hereby incorporated by reference into this ordinance, and the sale, <br />purchase or possession of alcohol contrary to State law shall be a <br />violation of this ordinance. <br />(2) It shall be unlawful for any person to consume <br />nonintoxicating malt liquor in any theater, recreation hall, <br />center, dance hall, ball park, or other place of public gathering <br />used for the purpose of entertainment, amusement or playing of <br />games, unless the owner or lessee of the property or sponsor of the <br />event has obtained a license or permit issued by the Park and <br />Recreation Director or his designee. <br />702.110. SUSPENSION AND REVOCATION. The Council shall either <br />suspend for up to 60 days or revoke any nonintoxicating 3.2 percent <br />702 -6 <br />Page 62 <br />
