(6) No more than one license shall be issued to any person in <br />the municipality. <br />(7) No retail license to sell alcoholic beverages may be <br />issued or renewed to a club which discriminates against members or <br />applicants for membership or guests of members on the basis of <br />race. <br />703.130. VIOLATION BY AGENT. Every licensee is responsible <br />for the conduct and the liycensed establishment and any sale of <br />alcoholic beverage by any employee authorized to sell such beverage <br />is the act of the licensee. <br />703.140. OPERATION HOURS. <br />(1) No "on- sale" sale of liquor shall be made after one <br />o'clock a.m. on Sunday, nor until eight o'clock a.m. on Monday, <br />except as provided herein. No such "on- sale" shall be made on <br />Tuesday, Wednesday, Thursday, Friday or Saturday, between the hours <br />of one o'clock a.m. and eight o'clock a.m. On Sunday, no such <br />"on- sale" sale shall be made except between the hours of ten <br />o'clock a.m. and one o'clock a.m. on Monday. <br />(2) No "off- sale" sales of such liquor shall be made before <br />eight o'clock a.m. or after eight o'clock p.m. on Monday, Tuesday, <br />Wednesday and Thursday, and before the hour of eight o'clock a.m., <br />or after the hours of ten o'clock p.m. on Friday and Saturday, and <br />no such "off- sale" sales of liquor shall be made at any time on <br />Sunday. No "off- sale" shall be made on New Years Day, January 1; <br />Thanksgiving Day or Christmas Day, December 25; but on the evenings <br />preceding such days, and on July 3, notwithstanding the above <br />provisions, "off- sale" sales may be made until ten o'clock p.m. <br />(3) No "on- sale" licensee shall permit the consumption of <br />intoxicating liquor on the premises during the hours when sale is <br />prohibited, except that the licensee shall be allowed a thirty <br />minute period following closing to clear the premises. Any <br />customer purchasing intoxicating liquor prior to 1:00 o'clock a.m. <br />may consume such beverage on the premises until 1:30 o'clock a.m. <br />Under no circumstances shall any individuals, whether or not <br />customers, other than the owners or employees of the licensee, be <br />allowed to remain on the premises after 1:30 o'clock a.m. <br />703.150. EXCEPTIONS OF SALE. This Chapter shall not be <br />construed to prohibit the sale of wine for sacramental purposes by <br />any person duly licensed by the State Liquor Control Commissioner, <br />nor shall this Chapter be construed to prohibit the sale of <br />medicine, nor of industrial alcohol designed for mechanical, <br />chemical, scientific, pharmaceutical or industrial purposes nor to <br />compound or preparations containing alcohol, if such compounds or <br />preparations are not potable as a beverage, nor shall it be <br />construed to prohibit the sale of intoxicating liquor for medicinal <br />703 -9 <br />Page 72 <br />
