704. SPECIAL ON -SALE WINE LICENSES <br />704.010. WINE LICENSES. No person, except a wholesaler or . <br />manufacturer to the extent authorized under the State License Code <br />shall directly or indirectly deal in, sell, or keep for sale in the <br />City any wine not exceeding 14% alcohol by volume without an <br />on -sale wine license. An on -sale wine license authorizes the sale <br />of wine not exceeding 14% alcohol by volume, for consumption on the <br />licensed premises only, in conjunction with the sale of food. An <br />on -sale wine license may be issued only to a restaurant having <br />facilities for seating not fewer than 25 guests at one time. For <br />purposes of this chapter, a restaurant shall mean an establishment <br />under the control of a single proprietor or manager, having <br />appropriate facilities for serving meals, and where in <br />consideration of payment therefore, meals are regularly served at <br />tables to the general public and which employs an adequate staff to <br />provide the usual and suitable services to its guests. <br />704.020. LICENSE APPLICATION. Any person desiring a special <br />"on -sale wine license" shall make a verified application in writing <br />to the City Council and shall file the same with the City <br />Administrator. Such application form shall require that the <br />information set forth in Section 703.040 be provided. In addition, <br />the application must include the location of the premises upon <br />which the applicant proposes to sell such wine and an exact <br />description of the particular place within the building where such <br />sales will take place. <br />704.030. REQUIREMENTS FOR INTOXICATING LIQUOR LICENSE <br />GENERALLY APPLY. Except as modified or amended in this Section, <br />provisions of Section 703 regulating intoxicating liquor licenses <br />shall apply to special on -sale wine licenses. <br />704.040. LICENSE FEES. The annual fee for a wine license is <br />$200.00. The license fee may subsequently be changed by Council <br />resolution. Each application for a wine license shall be <br />accompanied by a receipt from the Deputy City Clerk for payment in <br />full of a license fee. If an application for a license is <br />rejected, the Deputy City Clerk shall refund the amount paid. <br />704.050. COMBINATION WINE AND BEER LICENSE. A holder of an <br />on -sale wine license issued pursuant to this Section who is also <br />licensed to sell nonintoxicating 3.2 percent malt liquor pursuant <br />to Section 702, whose gross receipts are at least 60% attributable <br />to the sale of food, may sell intoxicating malt liquor at on -sale <br />without an additional license. <br />(Source: Ord. 345) <br />704 -1 <br />Page 75 <br />
