RESOLUTION FOR VACATING ROAD RIGHT -OF -WAY EASEMENT <br />WHEREAS, <br />The City Council of Little Canada has determined to vacate the <br />following drainage and utility easement over said property: <br />20 -foot drainage and utility easement shown lying between <br />Lots 1 and 3, Block 1; Heritage Office Park and northerly of <br />the NSP easement (Document No. 1963770 and Document No. <br />1688391) and southerly of the northerly six feet of said <br />Lots 1 and 3. <br />AND WHEREAS, <br />A public hearing was held on the 27th day of March, 1996 before <br />the City Council in the City Hall after due published and posted <br />notice had been given by the City Administrator, a reasonable <br />attempt was made to give personal notice to all affected property <br />owners, and all persons interested were given an opportunity to <br />be heard; <br />AND WHEREAS, <br />Any person, corporation or city owning or controlling easements <br />contained upon the property vacated, reserves the right to <br />continue maintaining the same or to enter upon such way or <br />portion thereof vacated to maintain, repair, replace, remove or <br />otherwise attend thereto; <br />AND WHEREAS, <br />It appears that it will be in the best interest of the city to <br />vacate such drainage and utility easement; <br />AND WHEREAS, <br />Four - fifths of all members of the City Council concur in this <br />resolution; <br />NOW, THEREFORE, BE IT RESOLVED, that the above - described drainage <br />and utility easement is hereby vacated. <br />Adopted by the Council this 27th day of March, 1996. <br />Attest: <br />Approved: <br />Michael I.
