The property
in question exists as a corner lot within an R -1, Single Family Residential Zoning District.
Within R -1 Districts, a 30 foot setback is imposed on all front yards and side yards which
abut public rights -of -way. In error, the applicable 30 foot side yard setback was not
applied to Mr. Thorp's accessory structure and it was constructed + 20 feet from the
property's side lot line. To "legalize" the accessory structure's existence, Mr. Thorp has
requested a variance from the City's R -1 District side yard setback requirements.
Attached for reference:
Exhibit A - Site Location
Exhibit B - Site Plan
ISSUES ANALYSIS
Variance Criteria. According to the Zoning Ordinance, a variance shall not be granted
unless it can be demonstrated that:
a. Special conditions and circumstances exist which are peculiar to the land, structure,
or building involved.
5775 Wayzata Blvd. • Suite 555 • St. Louis Park, MN 55416 • (612) 595- 9636•Fax. 595 -9837
Page 31
