NXC <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />PLANNING REPORT <br />TO: Little Canada Planning Commission <br />FROM: Cary Teague /Stephen Grittman <br />DATE: 7 October 1996 <br />RE: Little Canada - Thorpe - Variance & Special Home Occupation <br />FILE NO: 758.09 - 96.21 <br />BACKGROUND <br />Mr. Richard Thorpe is requesting an appeal of the City Council's denial of a variance to <br />allow the encroachment of an accessory building into the required side -yard setback. <br />Additionally, Mr. Thorpe is requesting a Special Use Permit to allow a Home Occupation <br />(Lawn Care Service). The subject property is located at 470 Costa Lane (a corner lot) <br />within the R -1, Single Family Residential Zoning District. <br />This past June, the City of Little Canada inadvertently issued a building permit to Mr. <br />Richard Thorp to allow construction of a 128 square foot detached accessory building <br />within a required side yard. Within R -1 Districts, a 30 foot setback is imposed on all front <br />yards and side yards which abut public rights -of -way. In error, the applicable 30 foot side <br />yard setback was not applied to Mr. Thorp's accessory structure and it was constructed <br />+/ -20 feet from the property's side lot line. <br />Attached For Reference: <br />Exhibit A - Site Location <br />Exhibit B - Site Plan <br />ANALYSIS <br />Variance <br />Variance Criteria: According to the Zoning Ordinance, appeals are processed according <br />to the variance procedures of the Ordinance.
