MINUTES <br />CITY COUNCIL <br />AUGUST 28, 1996 <br />CUP TO MOVE <br />EXISTING <br />GARAGE ONTO <br />A SINGLE - <br />FAMILY LOT - <br />155 EAST <br />VIKING DRIVE <br />Thorp reported that three of his neighbors are present <br />this evening to state that they prefer the shed where <br />it is now to a location in the back yard. <br />Scalze pointed out that the Code must be followed, and <br />if the City allowed this shed to remain, it would have <br />to allow other property owners the same privilege. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion by Scalze, seconded by Morelan, the public <br />hearing was closed. <br />Fahey suggested that staff work with Mr. Thorp on the <br />details for relocating the shed and bring back a <br />recommendation for Council's consideration. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RE$OLUTION NO. 96 -8 -198 - DENYING THE VARIANCE REQUEST <br />FOR SIDE YARD SETBACK ENCROACHMENT FOR A SHED AS <br />REQUESTED BY MR. RICHARD THORP BASED ON THE FACT THAT <br />THERE IS NO JUSTIFICATION FOR GRANTING THE VARIANCE <br />REQUEST, AND DECLARING THAT THE CITY WILL ASSIST MR. <br />THORP IN SOME FASHION TO RELOCATE OR REMOVE THE SHED <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) Scalze, Morelan, Fahey, Pedersen, LaValle. <br />Nays (0). Resolution declared adopted. <br />Fahey opened the public hearing to consider the <br />request for a Conditional Use Permit to move an <br />existing garage onto the single- family lot located <br />at 155 East Viking Drive as requested by Ted and <br />Shannon Huot. The Planning Commission has recommended <br />approval of the CUP. <br />Scalze asked if the Code specified locations for <br />garages. <br />The City Planner replied that the Code requires <br />compliance with required setbacks, and has no other <br />location requirements. <br />Scalze noted that Mr. Huot indicated household <br />flammable liquids would be stored in the garage. <br />The City Planner replied that some people prefer not to <br />6 <br />Page 46 <br />
