MINUTES CITY COUNCIL AUGUST 28, 1996 CUP TO MOVE EXISTING GARAGE ONTO A SINGLE - FAMILY LOT - 155 EAST VIKING DRIVE Thorp reported that three of his neighbors are present this evening to state that they prefer the shed where it is now to a location in the back yard. Scalze pointed out that the Code must be followed, and if the City allowed this shed to remain, it would have to allow other property owners the same privilege. There was no one present from the general public wishing to comment on this matter. Upon motion by Scalze, seconded by Morelan, the public hearing was closed. Fahey suggested that staff work with Mr. Thorp on the details for relocating the shed and bring back a recommendation for Council's consideration. Mrs. Scalze introduced the following resolution and moved its adoption: RE$OLUTION NO. 96 -8 -198 - DENYING THE VARIANCE REQUEST FOR SIDE YARD SETBACK ENCROACHMENT FOR A SHED AS REQUESTED BY MR. RICHARD THORP BASED ON THE FACT THAT THERE IS NO JUSTIFICATION FOR GRANTING THE VARIANCE REQUEST, AND DECLARING THAT THE CITY WILL ASSIST MR. THORP IN SOME FASHION TO RELOCATE OR REMOVE THE SHED The foregoing resolution was duly seconded by Morelan. Ayes (5) Scalze, Morelan, Fahey, Pedersen, LaValle. Nays (0). Resolution declared adopted. Fahey opened the public hearing to consider the request for a Conditional Use Permit to move an existing garage onto the single- family lot located at 155 East Viking Drive as requested by Ted and Shannon Huot. The Planning Commission has recommended approval of the CUP. Scalze asked if the Code specified locations for garages. The City Planner replied that the Code requires compliance with required setbacks, and has no other location requirements. Scalze noted that Mr. Huot indicated household flammable liquids would be stored in the garage. The City Planner replied that some people prefer not to 6 Page 46
