MINUTES <br />PLANNING COMMISSION <br />OCTOBER 10, 1996 <br />with the recommendations of the City Planner as <br />contained in his report dated October 8, 1996. <br />Motion seconded by Barraclough. <br />Motion carried 7 - 0. <br />MOBILEHOME The City Planner reported that the City has become <br />PARK ISSUES aware of some issues in mobilehome parks where single - <br />wide mobilehomes are being replaced with double - wides. <br />Most of the mobilehome parks in the City are non- <br />conforming uses. Therefore, the R -4 Mobilehome Park <br />Zoning requirements cannot be applied to these <br />properties. At one time the City proposed to rezone <br />the mobilehome parks to R -4. However, it was decided <br />that this zoning was not the highest and best use of <br />the property, and the commercial or industrial zoning <br />was left in place. <br />The Planner reported that the non - conforming use <br />section of the Code says that a non - conforming <br />structure cannot be relocated or replaced. Because the <br />owners of the mobilehome parks have been replacing <br />structures over the year, this is a technical violation <br />of the Zoning Ordinance. <br />Knudsen pointed out that if the letter of the law was <br />enforced, there would be an attrition within the <br />mobilehome parks until there were no mobilehomes left. <br />The Planner replied that while that is true, there is <br />the reality that the mobilehome park owners would then <br />never remove a mobilehome, and the homes would <br />deteriorate. This is not in the best interests of the <br />City. The City would like the mobilehome park owners <br />to be able to replace homes as they deteriorate, but <br />does not want to encourage additional density. The <br />Planner presented an ordinance amendment which would <br />address this situation. <br />Richard VerHagen reported that the owners of the North <br />Star Estates Mobilehome Park are using harassment and <br />threats to remove mobilehomes and replace them with <br />double - wides. VerHagen stated that since January six <br />residents have been harassed and forced to move. These <br />mobilehomes were then taken out and replaced with <br />double - wides.
