State law requires that the City make two findings before granting a variance: <br />(1) <br />(2) <br />Strict enforcement of the City ordinances would cause undue hardship <br />because of circumstances unique to your property. Undue hardship means <br />that: <br />(a) You cannot put your property to a reasonable use under City <br />ordinances. <br />(b) Your problem is due to circumstances unique to your property, that <br />you did not cause. <br />(c) The variance would not alter the essential character of the area. <br />The variance would be in keeping with the spirit and intent of the <br />ordinance. <br />Include a separate statement showing how you would meet these two findings. <br />e. A list of property owners and their addresses for your property and for all <br />properties within 350 feet. An abstract company or Ramsey County must prepare <br />and certify this list. Abstract companies are listed in the yellow pages. <br />2. For interpretation of the code, provide written justification for your appeal. Outline facts <br />where you believe the administrative official erred in interpreting the code. <br />3. For building code appeal, provide: <br />a. Written justification for your appeal. <br />b. Testing results which indicate that your proposal is equivalent or better than the <br />code requirement. <br />c. Six plans indicating the method of application to the particular job. <br />4. For a special Council agreement (for building), provide: <br />a. A site plan drawn to a scale showing your lot lines, the location of existing and <br />proposed buildings. Show all dimensions and any existing easements. At least one <br />plan must be 84/2" by 11 ".
