OCT -16 -1996 11:53 <br />CITY OF SHOREUIEW P.03/03 <br />214.020 Riparian Lot Variance. <br />(A) Riparian. An application for a riparian lot variance <br />and required information shall be submitted to the City <br />Planner. <br />(B) Consultation. The City Planner shall consult with other <br />City Department Beads to make the following <br />determinations: <br />(1) That the request is in general character with <br />surrounding properties. <br />(2) The request will not cause a traffic sight problem <br />or endanger public health or safety. <br />(3) The request will not adversely encroach upon a <br />public right of way, easement or utilities. <br />(C) Decision. Based upon the above determination, the City <br />Planner shall approve or deny the riparian lot variance. <br />If the decision is to approve, adjacent property owners <br />shall be notified of the decision and they shall have <br />five working days to submit an appeal of that decision <br />in writing to the City Manager. If the City Planner <br />denies the request, the applicant may, in writing and <br />within 5 days, submit an appeal to the City Manager. <br />(D) Board of Appeals. In the event of an appeal of the City <br />Planner's determination, the Board of Appeals and <br />Adjustments shall then review the application and make a <br />final determination. <br />(E) Expiration. A riparian lot variance granted but not <br />used shall become void one year after its effective <br />date. No application for the same or substantially the <br />same variance shall be made within six months of the <br />date of denial. <br />200 -157 <br />TOTAL P.03 <br />Page 98 <br />
