ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF LITTLE CANADA, MINNESOTA RESOLUTION NO. RESOLUTION APPROVING THE ENLARGEMENT OF DEVELOPMENT DISTRICT NO. 2 AND ADOPTING THE MODIFICATION OF THE DEVELOPMENT PROGRAM THEREFOR AND THE PROPOSED MODIFICATION OF THE TAX INCREMENT FINANCING PLAN FOR TAX INCREMENT FINANCING DISTRICT NO. 2-1 THEREIN. BE IT RESOLVED by the Board of Commissioners of the Little Canada Economic Development Authority ( "Authority ") of the City of Little Canada, Minnesota ( "City ") as follows: WHEREAS, the City Council ( "Council ") of the City of Little Canada previously adopted a Development Program for Development District No. 2 on February 14, 1990 and subsequently modified the Development Program for Development District No. 2 on April 11, 1990 and on November 22, 1995; and adopted a Tax Increment Financing Plan for Tax Increment Financing District No. 2 -1 on February 14, 1990 and subsequently modified the Tax Increment Financing Plan for District No. 2 -1 on April 11, 1990 and on November 22, 1995; WHEREAS, the Authority of the City has jurisdiction over the Development Program for Development District No. 2; WHEREAS, changes in project budgets, the addition of property to potentially be acquired in Development District No. 2 and Tax Increment Financing District No. 2 -1, and the request to change the boundaries of Development District No. 2 have necessitated modifications to the Development Program for Development District No. 2 and the Tax Increment Financing Plan for Tax Increment Financing District No. 2 -1; WHEREAS, the City Council of the City of Little Canada has proposed to modify the Development Program for Development District No. 2; and to modify the Tax Increment Financing Plan for theTax Increment Financing District No. 2 -1, all pursuant to and in accordance with Minnesota Statutes, Sections 469.001 to 469.047, Sections 469.090 to 469.108, and Sections 469.174 to 469.179, (the "Acts ") all inclusive, as amended; WHEREAS, the Authority and the Council have investigated the facts and have caused to be prepared the Modification of the Development Program for Development District No. 2 and the Modification of the Tax Increment Financing Plan for Tax Increment Financing District No. 2 -1, (collectively, the "Modifications "); and WHEREAS, the Authority and City have performed all actions required by law to be performed prior to the adoption of the Modifications, but not limited to, notification of Ramsey County and School District No. 623 having taxing jurisdiction over the property included in Tax Increment Financing District No. 2 -1, a scheduled review by the City Planning Commission of the proposed Modifications, and the scheduled holding by the Council of a public hearing upon published notice as required by law. -1- Page 6
