DEC-08 -1996 1108 <br />NBC <br />MEMORANDUM <br />WIC ATTACHMENT 7 612 595 9837 P.02/07 <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: December 6, 1996 <br />RE: Little Canada - Mobile Home Ordinance Amendments <br />FILE NO: 758.10 - 96. <br />This memorandum is intended to update the Planning Commission members as to the <br />status of the Citys activities in the Mobile Horne Parks. As you may recall, nearly all of the <br />Citys mobile home parks are non-conforming as to zoning district. At issue is whether the <br />park owners may continue to replace individual units in Tight of the City's non - conforming <br />use section of the Zoning Ordinance. <br />In order to facilitate the City's ability to be sure that public health, safety, and welfare are <br />not being jeopardized by crowding or other problems in the mobile home parks, the City <br />has developed an Ordinance amendment which refers to state standards for spacing, <br />setback, and other requirements. The Ordinance suggests that units will be allowed to be <br />replaced if these standards are complied with. It further suggests that in the event of a <br />catastrophic event which damages more than 50 percent of the individual unit capacity, the <br />land use must be made to conform to the applicable district. <br />The rationale for the first clause (replacement of units in conformance to state standards) <br />reflects the fact that the only standards in place at the time of original park development <br />were state standards, and that a recent state law change limits the ability of the City to <br />enforce more restrictive standards, in many cases.
