Hanson TO: Mayor Fahey & Members of the City Council FROM: Joel Hanson, City Administrator DATE: December 13, 1996 RE: Senior Deferred Assessment Payoff for Property at 65 E. Bryan Avenue The water main assessment for Improvement #76 -8 totalling $1,407.56 has been deferred pursuant to senior citizen status since its initial levy date. With interest payable through 1997, accrued interest totals $1,689.00 bringing the amount due for this assessment to $3,209.56. The property was sold back in 1992 to Richard Aguirre at which time the assessment should have been paid. It appears that an assessment search was not done and therefore this was not addressed at closing. We discovered it late last year and informed the property owner in early 1996. Since then, we have been discussing how to best resolve this matter. It is my recommendation that we do as follows: If in fact the title search was not done, we should receive payment from the property owner totalling $3,096.56 with the understanding that we will abate interest due and payable for the year 1997 of $112.60 given the delays in processing this matter. Should an assessment search be shown which indicates that this amount was missed in review by the City staff, I feel we should split the difference with the property owner for accrued interest and have a payoff amount totalling $2,646.16. I have discussed both these options with the property owner's representative and he has indicated agreement with this proposal.
