rA <br />Northwest Associated Consultants, Inc. <br />C O M M U N I T Y P L A N N I N G • D E S I G N • M A R K E T R E S E A R C H <br />MEMORANDUM <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: July 8, 1996 <br />RE: Little Canada - Hoggsbreath Special Purpose Fence CUP <br />FILE NO: 758.09 - 96.18 <br />Mr. Thomas Duray has requested a Conditional Use Permit to construct a "Special <br />Purpose Fence ". Such fences are allowed under the fencing regulations of the Zoning <br />Ordinance for fences in peculiar circumstances which exceed the normal height or <br />construction requirements. In this case, a fence which borders the Mobile Home Park <br />would have to adhere to the very restrictive residential height requirements of, generally, <br />six feet maximum. <br />However, this fence is intended to screen the activity of the bar /restaurant facility from the <br />residential use to the east. The appropriate method for the City to allow this type of <br />structure is through the Special Purpose Fence CUP, rather than a variance process. This <br />fence offers the following advantages over the existing conditions: <br />1. More effective noise abatement. <br />2. Better visual screening. <br />3. Less maintenance needs. <br />There are potential negatives to this request as well: <br />1. An 8 to 10 foot high block "fence" with a full footing and foundation is effectively a <br />building wall at or near the property line. <br />2.
