As originally build, <br />every home in this development included a deck that was accessed from either their dinning room or from <br />their kitchen area. <br />Proposed construction request: <br />As shown in exhibit 3 we are requesting to enclose the existing deck and convert it to a porch. <br />Request for variance: <br />During the application process for a building permit we were advised by the building inspector, Mr. Greg <br />Schmidt, that the proposed construction was not within the 30 foot setback as required by city code. The <br />existing deck is currently 7 feet over the 30 foot setback (23 feet from the rear property line). <br />A variance is being requested for the following reasons: <br />• As shown on exhibit 1 the house on this property is setback from all other adjacent and abutted <br />property which is therefore using at least the 7 feet being requested for the variance. Please note this <br />setback apparently was due to the fact that this property is the first home in the cul -de -sac. <br />• All other homes in this development can and have, as referenced in exhibits 5 and 6, build or convert <br />their deck into a porch without obtaining a variance because they significantly satisfy the setback <br />requirement. Please note that the two homes referenced in exhibits 5 and 6 are directly behind above <br />mentioned property. <br />• Building of a porch to the south of this home would also require a variance because it would violate the <br />10 foot side setback requirement. <br />• To maintain the setback requirement and convert the existing deck the size of the deck/porch would be <br />at least 1/2 of it's original size and therefore making it unusable. <br />Page 5 <br />
