After a general review of the issues raised, it was our <br />opinion that said issues may be adequately addressed by our <br />existing Code. Nonetheless, after discussing our current <br />Ordinances with Lieutenant Shanley, he believes some fine tuning <br />of our Code may assist the deputies. <br />Therefore, enclosed please find a proposed Ordinance <br />amendment regarding mobile home parks. As we have discussed, <br />Minnesota statutes §327.26 gives municipalities the power to <br />enact ordinances relating to mobile home parks as long as the <br />ordinance is for the safety and protection of persons or <br />property. As discussed below, we believe these ordinances may be <br />subject to challenge and we have therefore specifically <br />referenced Minnesota Statutes §327.26 within both sections. A <br />summary of the proposed provisions is set out below. <br />1) Section 404.010- Applicability of Traffic Regulatory <br />Provisions 3n Mobile Home Park$. <br />Pursuant to existing Little Canada Code Section <br />401.010, the highway traffic regulatory provisions of <br />Minnesota Statutes Chapter 169 are adopted by reference. <br />However, unless otherwise stated, Minnesota Statutes Chapter <br />169 applies only to offenses occurring on public roads. The <br />provisions of Minnesota Statutes Chapter 169 that do apply <br />on private roads include DWI and reckless driving.
