MINUTES <br />Planning Commission <br />August 8, 1996 <br />Grittman indicated that there are two used car sales <br />licenses in Little Canada already -- Joe Eich in Ryan <br />Industrial Park and Tom's Auto on County Road C. <br />Keis asked if they have reviewed the Planner's report and <br />the letter that indicates that they will only be allowed <br />five parking spaces. Madsen stated they have reviewed them. <br />He stated that the owner of the building is very particular <br />about his property and is only allowing them the use of five <br />spaces. <br />Knudsen recommended approval of the conditional use permit <br />for operation of a used car sales office at Best Auto & <br />Tire, 3011 Country Drive, subject to compliance with the <br />recommendations of the City Planner as outlined in his <br />report dated August 5, 1996. <br />Motion seconded by Barraclough. <br />Motion carried 5 - 0. <br />THORP Richard and Cindy Thorp of 470 Costa Lane were present to <br />VARIANCE request approval of a variance allowing encroachment of an <br />accessory building into the required sideyard setback on <br />their corner lot. Thorp indicated that he is building a <br />storage shed for his children's bikes, his saws, and other <br />miscellaneous items. He stated that he was not aware that a <br />special permit was needed for running a business out of his <br />home. He indicated that he will stop at City Hall tomorrow <br />to see if a special permit is needed. <br />Thorp stated that he would prefer to leave the shed in his <br />sideyard. He indicated that he was not aware there was a 30 <br />foot sideyard setback on a corner lot. He plans to run <br />electricity to the shed and does not want it in his backyard <br />where his children could dig up the electrical wires. <br />Thorp stated that he applied for a building permit for his <br />shed and the City approved it. He indicated that he told <br />City staff that he wanted to build the shed right next to <br />his house. Knudsen asked if Thorp told City staff the <br />distances from the lot lines and the size of the shed <br />proposed. Thorp said that he gave City staff all of that <br />information and they approved his permit. <br />Knudsen felt that there were two separate issues -- the <br />building permit was issued in error and there is a home <br />business. <br />Grittman stated that if the shed had been built in a <br />conforming area and was not in violation of the setback, the <br />Planning Commission would not have heard about it since it <br />would have been a building permit issue.
