Northwest Associated Consultants, Inc. <br />C O M M U N I T Y P L A N N I N G • D E S I G N • M A R K E T R E S E A R C H <br />PLANNING REPORT <br />TO: Little Canada Planning Commission <br />FROM: Bob Kirmis / Stephen Grittman <br />DATE: 5 August 1996 <br />RE: Little Canada - Thorp Variance <br />FILE NO: 758.09 - 96.21 <br />BACKGROUND <br />This past June, the City of Little Canada inadvertently issued a building permit to Mr. <br />Richard Thorp to allow the construction of a 128 square foot detached accessory building <br />within a required side yard of his property addressed as 470 Costa Lane. The property <br />in question exists as a corner lot within an R -1, Single Family Residential Zoning District. <br />Within R -1 Districts, a 30 foot setback is imposed on all front yards and side yards which <br />abut public rights -of -way. In error, the applicable 30 foot side yard setback was not <br />applied to Mr. Thorp's accessory structure and it was constructed + 20 feet from the <br />property's side lot line. To "legalize" the accessory structure's existence, Mr. Thorp has <br />requested a variance from the City's R -1 District side yard setback requirements. <br />Attached for reference: <br />Exhibit A - Site Location <br />Exhibit B - Site Plan <br />ISSUES ANALYSIS <br />Variance Criteria. According to the Zoning Ordinance, a variance shall not be granted <br />unless it can be demonstrated that: <br />a.
