MEMORANDUM <br />northwest Essociated consultants, inc. <br />TO: Little Canada Mayor and City Council <br />Little Canada Planning Commission <br />FROM: David Licht <br />DATE: 3 April 1985 <br />RE: Little Canada Zoning Ordinance Revision <br />FILE NO: 758.09 <br />We have been directed to provide an analysis of regulations pertaining to <br />car sales operations within the City. As an initial step in this process, <br />our office checked with a number of metropolitan communities housing major <br />car sales. A summary of our findings are attached to this memorandum. <br />While we strongly urge that you review this material, we would also add a <br />word of caution. It would appear that many of the established criteria are <br />legally questionable. A notable case in this regard is the provisions <br />requiring a certain percentage of vehicles to be new cars. From a legal <br />and land use perspective, we have difficulty in distinguishing between the <br />two types of vehicles. A car is a car, whether new or used and such a <br />distinction has no relevance to site, building or use standards. <br />Of the standards indicated from adjoining communities, there are several <br />which we believe warrant consideration for inclusion in the Little Canada <br />Code. These are: <br />1. All car sales /lease operations should be subject to a conditional use <br />permit, compliance to which is verified each year through the licensing <br />process. <br />2. There should be a ratio of interior display space to outdoor sales <br />display. <br />3.
