PLANNING REPORT <br />northwest associated consultants, inc. <br />TO: Little Canada Mayor and City Council <br />FROM: Stephen Grittman <br />DATE: 5 June 1985 <br />RE: DeBace /Zilge Subdivision <br />FILE NO: 758.09 - 85.19 <br />WW1 al <br />JUN 6 1935 <br />CITY OF <br />LITTLE CANADA <br />BACKGROUND <br />Mr. Robert DeBace and Mr. Robert Zilge have proposed the subdivision of <br />their property along Country Drive into four lots. The Council has required <br />the developers to;,plat the property. The location is illustrated on Exhibit <br />A. The proposed plat is attached as Exhibit B. <br />ANALYSIS <br />The plat consists of four lots, each in excess of the ordinance minimum of <br />20,000 square feet of lot area. However, Lot 4 has no direct street frontage, <br />and as such, does not conform to that Subdivision Ordinance requirement. Mr. <br />DeBace, who also owns the Outlot D to the north, proposes to cover Lot 4 and <br />Outlot D under a Planned Unit Development to assure proper access to Lot 4. <br />The developer indicates that the tenant on Outlot D wishes to expand and <br />may be interested in leasing Lot 4 and then purchasing it in the future. <br />Under this arrangement, the preference would be for the two parcels to be <br />combined. The developer has stated, however, that this is difficult to do <br />as Outlot D has a mortgage against it. As such a PUD agreement may be <br />utilized provided the proper conditions are niet. <br />Specifically, we would recommend that if PUD is used, a requirement of the <br />agreement be that once the current mortgages are paid, the lots be combined <br />at that tine. Thus, while the mortgage is in place, the lots will exist as <br />two separate lots functioning as one. Then when the encumbrance is lifted <br />the lots will be combined, eliminating the "administrative" lot line. Such <br />an arrangement would provide the City with the protection that the lot(s) <br />would always have to function together, rather than merely allowing two <br />unrelated uses to occupy one lot. <br />4820 minnetonka oIvd. mirneaJ N S, mn, sre 200 55416 (6121925 -9420 <br />
