As we have <br />discussed, the proposal meets with our office's general approval, subject to a few <br />requirements which are as follows: <br />A. Lot 4 and the Outlot D to the north are legally combined at such time as the <br />current mortgages are retired. <br />B. The PUD agreement covering these lots includes that requirement. <br />The reason for this is that you have indicated that the mortgage on Outlot D is the <br />only reason you are not combining the two lots now. Therefore, PUD is being used to <br />allow the creation of a nonconforming lot. It should be reasonable then to expect <br />that once the encumbrance is removed, the lots could then be combined. <br />As you are aware, the Council looks-unfavorably on the use of Planned Unit Develop- <br />ment if they believe it is being pursued simply to sidestep ordinance requirements. <br />For this reason I have sketched an alternative proposal for your consideration. All <br />lots are conforming, with 20,000 square feet and 100 feet widths. In addition, all <br />lots front on Country Drive, therefore no PUD arrangement would be necessary. <br />As this proposal avoids the PUD process, it would undoubtedly be more acceptable to <br />the Council. While the City takes our recommendations into account, they do not <br />always follow them. I have enclosed a copy of our report for your convenience.
