RESOLUTIONS <br />CITY COUNCIL <br />APRIL -12 -1978 <br />Klidzejs <br />Property <br />Division <br />And <br />Bldg. <br />Permit <br />Mr. Valento introduced the following resolution and <br />moved its adoption. <br />RESOLUTION NO. 78-4-098 - <br />A RESOLUTION APPROVING A DIVISION OF PARCEL <br />53- 03110 - 010 -77- WITH PROVISION -. <br />WHEREAS: Mr. Klidzejs, hereafter referred to as the <br />applicant, appeared before the Council requesting approval <br />of a property division of parcel -53- 03110- 010 -77, as indic- <br />ated on a survey marked clerk's exhibit no. 54. <br />NOW THERFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LITTLE CANADA. <br />That the land division of parcel 53- 03110- 010 -77, <br />as requested by Mr. Klidzejs, is hereby approved with the follow- <br />ing conditions. <br />A). <br />B). <br />C). <br />D). <br />That Mr. Klidzejs grant an easement for a <br />roadway equal in width and length and parallel to and <br />abutting the existing roadway easement along the South <br />line of the land in question. <br />Mr. Klidzejs enter into an agreement with the <br />City of Little Canada,whichwill run with the land, by which <br />both parties recognize the code provision for sub - standard <br />streets as stated in Section - 501.090 of the Little Canada <br />Code and such agreement be recorded in the office of the <br />Ramsey County Register of Deeds. <br />Said agreement shall provide for construction , <br />by the applicant, an adequate road within said easement <br />with a minimum of 16.5 ft. The design and construction of <br />said road shall be inspected by the engineer before any <br />building permit shall be issued. <br />The agreement shall provide that the City shall have <br />the right to claim title to all the land within said easement, <br />at any time in the future, if the judgement of the City Council <br />acquistion of said property for a public roadway would be in <br />the public interest. <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />AYES -5- Messrs; Valento,Hanson, De Bace, Jespersen and Nadeau. <br />Nayes -0- <br />Chair declared resolution adopted. <br />17 <br />
