RESOLUTIONS CITY COUNCIL APRIL -12 -1978 Klidzejs Property Division And Bldg. Permit Mr. Valento introduced the following resolution and moved its adoption. RESOLUTION NO. 78-4-098 - A RESOLUTION APPROVING A DIVISION OF PARCEL 53- 03110 - 010 -77- WITH PROVISION -. WHEREAS: Mr. Klidzejs, hereafter referred to as the applicant, appeared before the Council requesting approval of a property division of parcel -53- 03110- 010 -77, as indic- ated on a survey marked clerk's exhibit no. 54. NOW THERFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LITTLE CANADA. That the land division of parcel 53- 03110- 010 -77, as requested by Mr. Klidzejs, is hereby approved with the follow- ing conditions. A). B). C). D). That Mr. Klidzejs grant an easement for a roadway equal in width and length and parallel to and abutting the existing roadway easement along the South line of the land in question. Mr. Klidzejs enter into an agreement with the City of Little Canada,whichwill run with the land, by which both parties recognize the code provision for sub - standard streets as stated in Section - 501.090 of the Little Canada Code and such agreement be recorded in the office of the Ramsey County Register of Deeds. Said agreement shall provide for construction , by the applicant, an adequate road within said easement with a minimum of 16.5 ft. The design and construction of said road shall be inspected by the engineer before any building permit shall be issued. The agreement shall provide that the City shall have the right to claim title to all the land within said easement, at any time in the future, if the judgement of the City Council acquistion of said property for a public roadway would be in the public interest. The foregoing resolution was duly seconded by Mr. Hanson. AYES -5- Messrs; Valento,Hanson, De Bace, Jespersen and Nadeau. Nayes -0- Chair declared resolution adopted. 17
