License Agreement Related to the Banyon Data Systems, Utility <br />Billing System as of April 9, 1985. <br />For an annual fee of Three Hundred Fifty Dollars ($350.00), <br />Banyon Data Systems, will provide the Authorized City with the follow- <br />ing: <br />For New Users: <br />o Four diskettes containing the programs and sample billing <br />group. <br />o A copy of the User Manual. <br />For All Users: Upon completion by a minimum of one employee <br />of one -half (1/2) day training covering system use: <br />o Unlimited telephone access to a knowledgeable person. <br />o Notification of enhancements to the system and problems that <br />have been corrected. A new set• of diskettes will be offered at <br />a charge. All other support, other than what has been listed <br />above, will be performed as follows: <br />° Support service that can be performed in our facilities will <br />be billed at a rate of Forty -Five Dollars ($45.00) per hour. <br />° On -site support maintenance will be billed at a rate of <br />Forty -Five Dollars ($45.00) per hour for the actual time <br />involved in getting to the user, resolving the problem and <br />returning to our offices. Out -of- pocket costs will be billed <br />at actual cost. <br />That the license granted to Licensee under the Agreement with <br />Banyon Data Systems, authorized the use of the system licensed in any <br />machine - readable form at the Processor's computer site on its <br />4 <br />
