ORDINANCE NO 265 <br />AN ORDINANCE AMENDING IN ITS ENTIRETY THE LITTLE <br />CANADA CODE CHAPTER 1501 FILLING AND 1502 EXCAVATION <br />Section 1. That the Municipal Code of Little Canada, <br />Chapter 1501 and 1502 hereby amended to read as follows: <br />1501 - Filling and grading operations <br />1502 - Excavating operations <br />1501.010. PERMITS REQUIRED. No person, firm, or <br />corporation shall do any filling, grading, or excavating <br />without first having obtained a permit from the building <br />official except for: <br />1. An excavation below finished grade for basements <br />and footings of a building, retaining wall, or <br />other structure authorized by a valid building <br />permit. <br />2. Cemetary graves. <br />3. Excavations for wells or tunnels or utilities. <br />4. Mining quarrying, excavating, processing, <br />stockpiling of rock, sand, gravel, aggregate, or <br />clay where established and provided for by law, <br />provided such operations do not affect adjacent or <br />surrounding property. <br />5. Exploratory excavations under the directions of <br />soil engineers. <br />6. All excavating and grading covered by an <br />engineering escrow required by other city <br />ordinances or agreements. <br />7. The following provided that the building official <br />determines that there is no potential or actual <br />danger or detriment to public or private property <br />and no interference with natural drainage: <br />a. An excavation which is 2 feet or less in <br />depth and does not create a slope greater <br />than 5 feet in height and 1 1/2 to 1 slope. <br />b. Fill 3 feet or less in depth not intended to <br />support structures, which does not exceed 300 <br />cubic yards. <br />14 <br />
