1501.050. CONDITIONS OF PERMIT. The Council, as a <br />prerequisite to the granting of a permit, or after a permit <br />has been granted, may require the applicant to whom such <br />permit is issued, or the owner or user of the property on <br />which the excavation is located to: <br />(a) properly fence the excavation or fill; <br />(b) slope the banks, and otherwise properly guard and <br />keep the excavation in such condition as not to be <br />dangerous from caving or sliding banks; <br />(c) properly drain, fill in or level the excavation or <br />fill, after it has been created, so as to make the <br />same safe and healthful as the Council shall <br />determine; <br />(d) keep the excavation or fill within the limits for <br />which the particular permit is granted; and <br />(e) remove excavated material from the excavation, <br />away fron the premises, upon and along such <br />highways, streets or other public ways as the <br />Council shall order and direct. <br />1501.060. REPORTS AND ISSUANCE OF PERMIT. <br />(a) The City Clerk shall process all Land Fill or <br />Excavating Permit applications. Such applications for <br />less than one hundred (100) cubic yards shall be <br />forwarded to the City Building Official for approval. <br />(b) Such applications for more than one hundred (100) <br />cubic yards are subject to approval by the City <br />Council. The City Clerk shall forward such <br />applications to the City Engineer, City Building <br />Official, and to appropriate governing agencies where <br />watersheds and shorelines are involved. The city's <br />technical advisors shall be instructed by the Clerk to <br />prepare reports for the Council and the Clerk shall <br />state when such reports shall be in his hands for <br />Council consideration. <br />(c) Expenses incurred in the review of the application <br />which exceed the permit fee may be collected in an <br />action brought for that purpose in the name of the <br />City; or the City Clerk may certify to the County <br />Auditor the amounts due, including penalty, together <br />with the legal description of the premises served and <br />the County Auditor shall thereupon enter such amount <br />with the tax levy on said premises collectible with <br />the taxes for the next ensuing year. <br />1501.070. CONDITIONS OF OPERATION. Under no circumstances <br />shall any such land fill or excavating operation be <br />conducted or permitted if the contents of the land fill or <br />any part thereof shall consist of garbage, animal or <br />18 <br />
