Chlebeck <br />City Clerk <br />515 Little Canada Road <br />Little Canada, MN 55117 <br />RE: Purchase of Property at Ruth and Danont <br />Our File No. 4787 <br />Dear Mr. Chlebeck: <br />Telephone <br />(612) 222-2541 <br />I am writing to request your direction relating to the purchase of the <br />above- described property by the City. As you will recall, this is the property <br />that the City owned on a Public Use Restrictive Deed from the State of Minnesota. <br />Since the City no longer used the property for the public easement designated in <br />the State Deed, it was required to convey the property back to the State of <br />Minnesota. The City requested that Tony Reiter, the Ramsey County Land Commissioner, <br />prepare an appraisal of the subject property for the City to purchase it outright <br />from the State of Minnesota. Mr. Reiter's appraised value of the property was <br />$30,000.00, and the appraisals that the City obtained seemed to confirm the <br />$30,000.00 appraised value. <br />Mr. Reiter has recently contacted us and indicated that the City mist make <br />its decision on whether to purchase the property or else it may be sold at a <br />public auction to the highest bidder. I again spoke to Mr. Reiter on July 19, <br />1985, and Mr. Reiter indicated to me that the $30,000.00 appraised price may <br />be negotiable. He again stated; however, if the price is to be negotiated, <br />he must have something from the City in writing such as a soil report, or <br />other competent opinion that the property has either soil problems or other <br />characteristics which will affect the development or other use of the property. <br />In other words, he is willing to negotiate the price but he must base his <br />decision on additional facts establishing that the property has problems. <br />It may also be possible for the City to reacquire the subject property <br />subject•to a different public use restriction. If the City desires to do that, <br />we must obtain Mr. Reiter's approval of the public use and then make application <br />through his office. I would suggest that if the City wishes to proceed to <br />reacquire the property subject to another public use, it first should determine <br />what the public use would be and then contact Mr. Reiter for his approval prior <br />to maldes application. <br />3.3 <br />IRr211Wij <br />.1111 22 19 <br />CITY OF <br />LITTLE CANADA <br />
