MEMO <br />TO: Mayor and City Council <br />FROM: Bud Nagovsky <br />DATE: July 23, 1985 <br />SUBJ: Chapter 70 and UBC Appendix <br />I have reviewed our present ordinance 239 and chapter 70 excavating and <br />grading of the UBC. I have also reviewed the memo from Northwest Associated <br />Consultants. Basically both chapter 70 and ordinance 239 control the <br />excavating and filling of land. Chapter 70 is much more detailed in what is <br />exempt from and what requires a permit. The specific engineering data <br />mentioned by Mr. Vick in the memo pertains to excavating and filling in <br />preparation for building a structure on the land. Stable ground for a <br />structure requires more engineering than just filling land for yards, <br />parking, etc. <br />If the soil is suspect, I require that soil borings, compaction tests, etc. <br />be filed with me prior to any building. These engineering costs are borne <br />by the owner. Any large project is automatically reviewed by the City <br />Engineer and paid for by the developer. Sec. 7006(C) of chapter 70 allows <br />the building official to determine what engineering data will be needed. <br />As to the permit fees, my feelings are that the fee schedule in the present <br />ordinance is too high. The fee schedule in chapter 70 is more in line with <br />my thinking on fee charges. Perhaps a fee somewhere between ordinance 239 <br />and chapter 70 could be incorporated into ordinance 239. To sum up, chapter <br />70 is oriented towards excavating and filling land for structures to build <br />on. Ordinance 239 controls the movement of earth for fill purposes. <br />Suggestions for amending or rewriting ordinance 239: <br />Section on definitions (none in 239) <br />Should include section on exceptions for permits (none in 239) <br />All exceptions in chapter 70, UBC 7003 1 through 9 (see attached sheet) <br />Add 10. Fill necessary to obtain the proper grade around a new structure, <br />provided it does not interfere with natural drainage or create a <br />problem for adjoining property. <br />Add 11. All development covered by an engineering escrow required by <br />other city ordinances or agreements. <br />Add to 1501.030 (1) Building official shall determine required data from <br />1501.020 of this ordinance. <br />(2) Owner or developer shall be responsible for all required <br />data and the city engineer shall check same for approval. <br />Permit Fees: <br />Table 70 -B of UBC (copy attached) covers infinite amount of fill. Present <br />ordinance 239 stops fee escalation at 251 cu. yards. <br />kg <br />3 <br />
