The existing lots all front on Bryan Street, and are part of <br />Round Lake Addition, Block 3, Lots 1 -10. In addition, the applicant wishes <br />to have the alley at the rear of these lots vacated, and added to the rear <br />of each of his new lots. One complication is the existence of a house which <br />sits across the lot line between the existing lots 4 and 5 and also sits across <br />the alley. <br />ANALYSIS <br />This application raises a number of issues. First regards the ordinance re- <br />quirement of a plat. Curent City policy allows the creation of three or fewer <br />lots to occur without formal platting. This application creates five new lots. <br />The applicant has stated that platting shouldn't be required as the new lots <br />use previously platted lot lines. However, the lots, to meet minimum R -1 area <br />requirements need to add the alley which has no legal description. Thus, all <br />new lots will be described by a metes and bounds method, complicating identi- <br />fication and recording. <br />Further, if the vacated alley is divided in half and added to both the appli- <br />cant's property and the abutting property to the south, the new corner lot will <br />need an additional 4 to 5 feet to meet area requirements.
