PLANNING REPORT <br />nortLwest Essociated consultants, inc. <br />TO: Little Canada Mayor and City Council <br />FROM: Stephen Grittman <br />DATE: 15 August 1985 <br />RE: Boss Subdivision <br />FILE NO: 758.09 - 85.27 <br />[-IgT2117k) <br />AIM 16 1985 <br />CITY OF <br />LITTLE CANADA <br />BACKGROUND <br />At its meeting of 8 August 1985, the Planning Commission granted Dick Boss <br />' approval of a preliminary plat concept for five lots. His proposal has <br />evolved considerably since our original report was written (5 August 1985). <br />At that time the proposal was through combinations to create five new lots <br />from ten previously platted lots. A complication exists in the form of a <br />house which straddles the lot line between lots 4 and 5, also sits on the <br />alley, and across the alley on the neighbor's property. In order to avoid <br />those problems, Mr. Boss was proposing to petition to have the alley vacated <br />and added entirely to his property, and also to pursue ownership of the <br />neighbor's land underneath the house. <br />This concept met with our approval with two exceptions. First, the applicant <br />did not wish to plat the subdivision which is against City resolution requir- <br />ing a subdivision of four or more lots to be in the form of a plat. Second, <br />the house would have continued to straddle lot lines - new lots 2 and 3. <br />The Little Canada Zoning Ordinance requires that non - conforming structures or <br />uses may be changed only to lessen the non - conformity. The proposed subdivision <br />would not have succeeded on this issue. Our recommendation was for approval <br />subject to the filing of a proper preliminary plat and relocation of the house <br />(or a lot line) so that the house would site entirely upon one lot. <br />At the Planning Commission meeting, the applicant stated that due to opposition <br />of the neighbors, the request for the alley vacation had been dropped. This <br />created problems with lot sizes and as such, he wished to move lot lines off <br />of the previously platted lines.
