CHLEBECK, Clerk <br />515 Little Canada Road <br />Little Canada, Minn. 55117 <br />484 -2177 <br />DATE: April 9, 1986 <br />TO: Planning Commission <br />Park Commission <br />FROM: Joe Chlebeck3it' <br />RE: Use of NSP Property for Park Purposes <br />I have discussed this matter with our Insurance Agents and <br />they have advised us that before any park construction <br />takes place, we should have an agreement with NSP for <br />permission to develop this park system. Most crucial to <br />this development is liability. When property is owned by <br />private individuals, they would not invite the public onto <br />the property. In the event that this becomes City <br />property, you are inviting the public onto the property, so <br />the question of liability now arises. Who is liable for <br />what: <br />1. You may recall a couple of days ago there was an <br />airplane crash in Lake Elmo. No one was seriously <br />injured but the lines did come down. <br />2. The concern was raised with the residents in the area <br />some time ago of possible health hazards under the <br />lines. <br />3. If the property is to become a park, it appears that we <br />need a hearing to rezone the property from R -1 to <br />Public before we commence construction. At a Public <br />Hearing the health question will rise again. <br />4. We went through the Sofie- Petersen plat before and <br />decided that the road was not to go to County Road D. <br />The utilities have to go to County Road D.
