CITY OF LITTLE CANADA
RAMSEY COUNTY, MINNESOTA
Office of:
JOSEPH G. CHLEBECK, Clerk
515 Little Canada Road
Little Canada, Minn. 55117
484 -2177
DATE: April 9, 1986
TO: Planning Commission
Park Commission
FROM: Joe Chlebeck3it'
RE: Use of NSP Property for Park Purposes
I have discussed this matter with our Insurance Agents and
they have advised us that before any park construction
takes place, we should have an agreement with NSP for
permission to develop this park system. Most crucial to
this development is liability. When property is owned by
private individuals, they would not invite the public onto
the property. In the event that this becomes City
property, you are inviting the public onto the property, so
the question of liability now arises. Who is liable for
what:
1. You may recall a couple of days ago there was an
airplane crash in Lake Elmo. No one was seriously
injured but the lines did come down.
2. The concern was raised with the residents in the area
some time ago of possible health hazards under the
lines.
3. If the property is to become a park, it appears that we
need a hearing to rezone the property from R -1 to
Public before we commence construction. At a Public
Hearing the health question will rise again.
4. We went through the Sofie- Petersen plat before and
decided that the road was not to go to County Road D.
The utilities have to go to County Road D. In
reviewing this with Roger he is also of the opinion
that the street should go through for public safety
purposes.
44
MAYOR
Michael Fahey
COUNCIL
Beverly Scalze
Bill Biesener
Rick Collova
Mugs Nardini
